Under Schedule 2, Part 1 (Paragraph 2) of the Data Protection Act 2018, organisations such as the police, government departments and local authorities with regulatory powers are able to request access to third party personal information without the consent of the data subject for the purposes of:
- prevention or detection of crime
- the apprehension or prosecution of offenders; or
- the assessment or collection of a tax or duty or an imposition of a similar nature
There is no automatic right of access to information under Schedule 2, Part 1 (Paragraph 2) of the Data Protection Act 2018. Each request will be considered to decide whether or not to apply the exemption and provide the information. This guidance does not overrule or replace other Information Sharing Agreements, Memorandum of Understandings or Processes.
