NL Active Terms and Conditions 

1 These terms 

1.1 What these terms cover. These are the terms and conditions on which we supply your membership to you.  

1.2 Why you should read them. Please read these terms carefully before you sign these terms. These terms tell you who we are, how we will provide your membership to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.  

2 Information about us and how to contact us, definitions and interpretation  

2.1 Who we are. We are North Lincolnshire Borough Council who official address is Church Square House, 30-40 High Street, Scunthorpe, North Lincolnshire, DN16 5NL 

2.2 How to contact us. You can contact our membership team by writing to us at memberships@northlincs.gov.uk  or telephoning on 01724 291900. 

2.3 How we may contact you. If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us.  

2.4 “Contract” means these terms and conditions, the Health Commitment Statement, your application, any welcome letter and the specific terms and conditions associated with your membership as set out on our website NL Active – North Lincolnshire Council.  

2.5 “Facilities” means the leisure facilities provided under your membership.  

2.6 “Force Majeure Event”: any circumstance not within aour reasonable control including: 

a. acts of God, flood, drought, earthquake or other natural disaster;  

b. epidemic or pandemic;  

c. terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations;  

d. nuclear, chemical or biological contamination or sonic boom; 

e. any law or action taken by a government or public authority, including imposing an export or import restriction, quota or prohibition; 

f. collapse of buildings, fire, explosion or accident; and 

g. any labour or trade disputes, strikes, industrial action or lockouts. 

2.7 “Membership” means the relevant membership which you wish to take up as more specifically identified by you at the point in which you sign up to the membership on our website NL Active – North Lincolnshire Council and as set out in the relevant specific terms and conditions for that the membership you sign up to.  

2.8 “Services” means any leisure or group fitness classes, equipment or training that may be provided by us to you under your Membership.  

2.9 “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails. 

3 Our contract with you 

3.1 How we will accept your membership. Our acceptance of your Membership will take place when upon you accepting these terms and conditions including the specific terms and conditions associated with your Membership by completing the application process on our website at which point a contract will come into existence between you and us.  

3.2 If we cannot accept your membership. If we are unable to accept your Membership, we will inform you of this in writing and will not charge you for the Membership. This might be because of unexpected limits on our resources which we could not reasonably plan for or because we have identified an error in the price or description of the Membership. 

3.3 Your right to cool off.   

a. You have a fourteen (14) day cooling-off period from the date of acceptance of your Membership during which you can cancel this Contract.  

b. If you choose to cancel this Contract within the fourteen (14) days cooling-off period we shall charge an administration fee in the sum of £20 for administrative purposes only and any Membership Fees paid by you will be refunded where the Membership is cancelled in accordance with this clause.  

3.4 Your membership number and card/wristband 

a. We will assign a membership number to you and will provide you with a membership card or wristband and we will require your photograph to be taken for identification purposes. This photograph will be held securely on our database. If you refuse to have your photograph taken additional photo and address identification will be required on every visit.  

b. Your membership card/wristband must be shown at our facilities on every visit either at reception or at the self-check-in kiosk to register your attendance.   

c. You must not allow your card/wristband to be used by any other person for any reason. If your membership card/wristband is used by any other person we reserve the right to cancel your membership with no refund of your Membership Fee’s 

d. We reserve the right to charge a fee for the replacement of a new membership card/wristband.  

3.5 We only sell to the UK. Our website is solely for the promotion of our services in the UK. 

3.6 Terms of your membership. Unless identified within the specific membership terms and conditions set out on our website, this Contract and your Membership shall run for a minimum period of one (1) month and shall automatically continue unless it is cancelled in accordance with the provisions set out in the contract.  

4 Your rights to make changes 

4.1 If you wish to make a change to your Membership, please contact us (see clause 2.4). We will let you know if the change is possible. If it is possible we will let you know about any changes to your Membership fees, the timing or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change. 

5 Our rights to make changes 

5.1 Changes to the membership. We may change any Membership and any other Services included within the Membership:  

a. to reflect changes in relevant laws and regulatory requirement; and 

b. to implement technical adjustments and improvements, for example to address a security threat. These changes will not affect your use of the Facilities and Services. 

6 Providing the services and/or facilities under a membership 

6.1 When we will provide the services and/or facilities. We will supply the Services to you from the date of your Membership until either you end the Contract in accordance with clause 7 or we end the Contract by written notice to you as described in clause 8 

6.2 We are not responsible for delays or cancellations outside our control. If our performance of the Services is affected by an event outside our control, then we will contact you as soon as possible to let you know, and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event but if there is a risk of substantial delay you may contact us to end the Contract and receive a refund for any Services you have paid for but not received.  

6.3 Not used 

6.4 What will happen if you do not provide required information to us. As we informed you, the description of the Membership is on our website, we will need certain information from you so that we can provide the correct Membership and relevant Services/Facilities associated with that Membership to you. We will contact you in writing to ask for this information. If you do not, within a reasonable time of us asking for it, provide us with this information, or you provide us with incomplete or incorrect information, we may either end the Contract or make an additional charge of a reasonable sum to compensate us for any extra work that is required as a result. We will not be responsible for providing the Membership Services/Facilities late or not providing any part of them if this is caused by you not giving us the information, we need within a reasonable time of us asking for it.  

6.5 Reasons we may suspend the membership, facilities and/or services. We may have to suspend your Membership and/or the Services to: 

a. deal with technical problems or make minor technical changes; 

b. update the Facilities/Services to reflect changes in relevant laws and regulatory requirements; 

c. undertake construction and/or refurbishment works to the Facilities; 

d. make changes to the services as requested by you or notified by us to you (see clause 5). 

e. if there is a Force Majeure Event 

6.6 Your rights if we suspend the membership. We will contact you in advance to tell you we will be suspending the Facilities and/or Services, unless the problem is urgent or an emergency. If we have to suspend the Services and/or Facilities for longer than four (4) consecutive weeks we may adjust the Membership Fee while they are suspended. You may contact us to end the Contract if we suspend the Services and/or Facilities, or tell you we are going to suspend them, in each case for a period of more than four (4) weeks.  

6.7 Your rights to suspend or pause your membership.   

a. You may request for your Membership to be suspended or paused for up to two (2) periods within any twelve (12) month period, with each suspension lasting no more than three (3) months with the total suspension period lasting no more than 6 months 

b. You can only put a request in for your membership to be suspended or paused after your first monthly payment has been received.  

c. The minimum period for a suspension is one (1) calendar month provided that you have given fourteen (14) days written notice which shall be given before the first day of each calendar month. Requests to suspend a Membership cannot be backdated and will run for a full calendar month after notification by you. Any request to suspend your membership must be made in writing either at the facilities or by email to memberships@northlincs.gov.uk. If you pay your Membership Fee by Monthly Direct Debit (MDD) an additional fee of £5 is payable each month that your Membership is suspended.  

7 Your rights to end the contract 

7.1 If you pay your membership by MDD you can end the contract at any time. Subject to clause 7.2 below, you may contact us at any time to end the contract for the membership by giving us thirty (30) days written notice, but in some circumstances, we will l collect a final monthly payment for depending on the notice period given. Request to cancel your Membership can be submitted using the online cancellation form which can be found at www.northlincs.gov.uk/nlactive .  

7.2 If you have paid for your membership in a one-off annual fee you may request to end your contract at any time on one of the following grounds:  

a. on medical grounds where evidence has been provided that a medical professional has advised against physical activity; or 

b. you’re located outside of North Lincolnshire and you have provided proof that you are no longer a resident of North Lincolnshire; or 

c. you are being made redundant by your employer and you have provided evidence of this by way of a letter from your employer; or  

d. we actively reduce the facilities, change their location or opening hours of those which are associated with your membership: 

We will refund any part of your Membership Fee that has been paid in advance which relates to the period after your Membership has ended provided that you have given thirty (30) days written notice of your intention to cancel the Membership and you have completed the online cancellation form which can be found at www.northlincs.gov.uk/nlactive .  

8 Our rights to end the contract 

8.1 We may end the contract if you break it. We may end the Contract at any time, and reserve the right to retain any element of your Membership Fee, by writing to you if: 

a. you do not make any payment to us when it is due and it remains unpaid fourteen (14) days after the date it is due; 

b. you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the Membership; 

c. you commit a serious or repeated breach of this Contract, including any specific terms associated with your Membership, and you fail to rectify any breach within fourteen (14) days to our satisfaction; and/or 

d. your behaviour or conduct is likely to endanger members of the public, staff or the reputation of us. 

8.2 We may end the Contract at any time by giving you thirty (30) days written notice. 

8.3 We may stop providing the Services/Facilities. We may write to you to let you know that we are going to stop providing the Services/Facilities. We will let you know at least thirty (30) days in advance of stopping the services/facilities and will refund any sums you have paid in advance for services which will not be provided. 

9 If there is a problem with the Services/Facilities 

9.1 How to tell us about problems. If you have any questions or complaints about the services or the Facilities provided under your membership, please contact us. You can contact us by telephoning our membership team at 01724 291900 or by writing to us at memberships@northlincs.gov.uk . Alternatively, please speak to one of our staff at the Facilities. 

10 Price and payment 

10.1 Where to find the price for the Membership and Services/Facilities associated with your Membership. The price of your Membership (which includes VAT) will be the price set out in the specific Terms and Conditions for the membership you have purchased (“Membership Fee”). We take all reasonable care to ensure that the prices of the Membership advised to you are correct. However please see clause 10.3 for what happens if we discover an error in the price of your membership.  

10.2 We will pass on changes in the rate of VAT. If the rate of VAT changes, we will adjust the rate of VAT that you pay, unless you have already paid for the services in full before the change in the rate of VAT takes effect. 

10.3 What happens if we got the price wrong. It is always possible that, despite our best efforts, some of the Memberships we provide may be incorrectly priced. We will normally check prices before accepting your Membership. If we accept and process your Membership where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may refund you any sums you have paid that are in excess of the price. We also reserve right to claim additional sums if the price is less than stated within your specific Membership Terms and Conditions and/or our website (www.northlincs.gov.uk/nlactive ) 

10.4 When you must pay. Subject to any specific terms of your Membership.  

a. If you choose to pay for your Membership in full (“Annual Membership”) it must be paid prior to or on the date we accept your membership application. Your Membership will run for a period of twelve (12) consecutive months from the date of payment; 

b. if you choose to pay by monthly direct debit (“MDD”) you shall pay the joining fee and the first month Membership Fee upfront (that may be pro rata should your application, be accepted part way through a month).  

c. MDD payments will then be due on the 1st of each calendar month, if the 1st of the month falls on a bank holiday or weekend, payment will be collected on the next bank working day. 

d. If you choose to pay by MDD when you have paid your final payment of the Membership Fee it is your responsibility to cancel the direct debit with your bank. We shall not be liable for monies sent across by your bank as a result of your direct debit is not cancelled by yourself. 

10.5 How you must pay 

a. Annual Membership fees will be paid for at the Facility either by way of debit or credit card:  

b. MDD will be paid by direct debit and you must complete a direct debt agreement using the form on our website;  

c. Membership Fees paid by MDD will be paid in advance. If you fail to make a payment on time you will incur the additional following charges to the monthly Membership Fee:  

i) £5for any other payment not by MDD; and/or 

ii) £15if you fail to pay your monthly Membership Fee within 7 days of the date it is due. 

10.6 We reserve the right to increase membership fees at any time, If we increase the Membership Fees and you wish to cancel your Membership you must notify us in writing immediately and your Membership shall end thirty (30) days after the date we receive notification from you. Notification must be provided to memberships@northlincs.gov.uk or by completing a cancellation form which is available on our website.  

10.7 What to do if you think the membership fee is wrong. If you think Membership Fee is wrong, please contact us promptly at memberships@northlincs.gov.uk  to let us know. You will not have to pay any interest until the dispute is resolved. Once the dispute is resolved if applicable, we will charge you interest on correctly invoiced sums from the original due date. 

11 Our responsibility for loss or damage suffered by you 

11.1 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this Contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process. 

11.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the services.

12 How we may use your personal information 

12.1 We will use the personal information you provide to us to: 

a. provide the Membership Services and Facilities appropriate to your specific Membership; and 

b. if you agreed to this, to inform you about similar products that we provide, but you may stop receiving these communications at any time by contacting us. 

12.2 Not used 

12.3 Information Governance and Data Protection. We are regulated under the Data Protection Act 2018 and the General Data Protection Regulations (“GDPR”) and treat all information we hold confidentially and securely.  We collect and process your personal data in accordance with the Data Protection Act 2018, GDPR and any other relevant legislation. We will not disclose any of your personal data to any third party unless allowed or required to do so under GDPR or any other relevant legislation. 13 Other important terms 

13.1 We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract. If you are unhappy with the transfer you may contact us to end the contract within forty five (45) days of us telling you about it and we will refund you any payments you have made in advance for the membership and its associated services and facilities not provided. 

13.2 Rules and regulations you agree to comply with the Facility rules and regulations: including but not limited to:  

a. General Regulations and Conditions of Hire; 

b. Admissions Policy 

c. Group Fitness Class Etiquette and Gym Etiquette 

We may make reasonable changes to the rules at any time and will use reasonable endeavours to give you at thirty (30) days’ notice of the changes (either in writing via email, or by prominently displaying a notice at reception). 

13.3 Facilities 

a. You will only be permitted to use your Membership if your Membership is fully paid. 

b. Classes and activities at the Facilities must be pre-booked, as a member you can book 7 days in advance. If you do not cancel or attend a Class, you will be charged a “No Show” charge of 50p per class not attended or cancelled in advance in addition to your Membership Fee. You will be unable to make any future bookings until the No Show charge is paid. Group fitness classes can be cancelled up to 2 hours before the start of the class if you are unable to attend. Classes cancelled after this time will not be refunded or moved to another date. If you continually book classes that are not attended it will result in your booking rights being suspended by us.  When attending classes/ sessions you must ensure you have checked in at reception or on the self-check-in kiosk to confirm your attendance. 

c. Details of the Facilities opening hours and activities included in your membership can be found online at www.northlincs.gov.uk/nlactive. Copies are available on request. On bank holidays and between the Christmas period, our Facility opening hours may vary. All Facilities will be closed on Christmas Day, Boxing Day and New Years Day. 

d. We reserve the right to change any programme, cancel bookings, withdraw or remove facilities from time to time for essential repair and maintenance. Any changes will be displayed at reception of the Facility reasonably in advance. If we make significant changes to opening hours or facilities, you can cancel your Membership in accordance with clause 7.3 of the core terms and conditions. 

e. During school holidays, the swimming pool may reach maximum bather load, therefore a bands system will be in operation for swimmers. This guarantees all swimmers a minimum swim time of 40 minutes. However, we do not guarantee entry to swimming sessions during busy periods. 

f. If you have any questions or complaints about the services or facilities provided under your membership, please contact the centre management team at your home centre. You can contact us on 01724 291900 option 3 and then the relevant site option, and ask to speak to the Duty Manager, or by writing to memberships@northlincs.gov.uk   

13.4 Use of Equipment and Facilities 

a. Before using the gym, all junior members must complete an induction with an instructor who will explain the safe and proper use of the equipment. You must not use any equipment or undertake any exercise that you have not been instructed to use. 

b. Before using the gym, members with underlying medical conditions must compete an induction with an instructor who will explain the safe and proper use of the equipment. You must not use any equipment or undertake any exercise that you have not been instructed to use. 

c. You must take care to safeguard yourself and others when using the gym equipment. We ask you to make sure free weights are placed back on the racks provided and not left on the floor, spotters must be used when performing lifts with barbells and on the ‘smith’ machine, and all safety guards must be left in position. 

d. You are asked not to instruct other members in training methods but refer them to an instructor 

e. You must register at the reception of the Facility prior to participating in your chosen activity. 

f. Mobile phones are permitted in the gym for members to access their own music. However, the taking of photograph and making /accepting of calls is strictly prohibited whist working out 

g. You must wipe and/or clean down all equipment after use  

13.5 Nobody else has any rights under this contract. This Contract is between you and us. No other person shall have any rights to enforce any of its terms. Neither of us will need the consent of any person acquiring rights under our guarantee to end the Contract or make any changes to these terms. 

13.6 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect. 

13.7 Even if we delay in enforcing this Contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this Contract, that will not mean that you do not have to do those things or prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the Membership and its associated Services and Facilities, we can still require you to make the payment at a later date. 

13.8 Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the membership in the English courts. 

 

NL CORE Membership Specific Terms and Conditions 

These terms and conditions form our Contract with you and should be read in conjunction with the General Terms and Conditions.  

  1. Membership

1.1  We operate seven Gym/ Leisure Facilities within North Lincolnshire. Our membership gives you access to the following facilities: 

  • Ancholme Leisure Centre – Brigg 
  • Axholme North Leisure Centre – Crowle 
  • Baysgarth Community Hub – Barton-Upon-Humber 
  • Live Well Isle of Axholme – Epworth 
  • Riddings Community Hub – Scunthorpe 
  • The Pods – Scunthorpe 
  • Winterton Gym – Winterton 

 

1.2  This Membership includes:

2.2 You shall pay your Membership Fee in accordance with clause 10 of the General Terms and Conditions. 

2.2 Use of certain activities not included as part of your membership package will be subject to payment of current fee charges, which are in addition to this Membership subscription. 

2.3  A list of tariff charges is available from a Facility’s. 

NL Unlimited Membership Specific Terms and Conditions 

These terms and conditions form our Contract with you and should be read in conjunction with the General Terms and Conditions.  

  1. Membership

1.1  We operate seven Gym/ Leisure Facilities within North Lincolnshire. Our membership gives you access to the following facilities: 

  • Ancholme Leisure Centre – Brigg 
  • Axholme North Leisure Centre – Crowle 
  • Baysgarth Community Hub – Barton-Upon-Humber 
  • Live Well Isle of Axholme – Epworth 
  • Riddings Community Hub – Scunthorpe 
  • The Pods – Scunthorpe 
  • Winterton Gym – Winterton 

 

1.2 This Membership includes:

  1. Charges

2.1  You can use your Membership at any Facility and the price for this membership is £37.99 per month (“Membership Fee”) but may be subject to change in accordance with clause 10.6 of the General Terms and Conditions. 

2.2 You shall pay your Membership Fee in accordance with clause 10 of the General Terms and Conditions. 

2.2 Use of certain activities not included as part of your membership package will be subject to payment of current fee charges, which are in addition to this Membership subscription.

NL Surge Membership Specific Terms and Conditions 

These terms and conditions form our Contract with you and should be read in conjunction with the General Terms and Conditions.  

  1. Membership

1.1  Our membership gives you access to the following facilities: 

  • Ancholme Leisure Centre – Brigg 
  • Axholme North Leisure Centre – Crowle 
  • Baysgarth Community Hub – Barton-Upon-Humber 
  • Riddings Community Hub – Scunthorpe 
  • The Pods – Scunthorpe 

 

1.2  This Membership includes:

NL Ignite (14 to 17 years) Membership Specific Terms and Conditions 

These terms and conditions form our Contract with you and should be read in conjunction with the General Terms and Conditions.  

  1. Membership

1.1  We operate seven Gym/ Leisure Facilities within North Lincolnshire. Our membership gives your Child access to the following facilities: 

  • Ancholme Leisure Centre – Brigg 
  • Axholme North Leisure Centre – Crowle 
  • Baysgarth Community Hub – Barton-Upon-Humber 
  • Live Well Isle of Axholme – Epworth 
  • Riddings Community Hub – Scunthorpe 
  • The Pods – Scunthorpe 
  • Winterton Gym – Winterton 

 

1.2  This Membership includes: 

Membership type  Activity access 
 NL Ignite (14 to 17 years) 
  • Use of the gym (with parent or guardian unless waiver has been provided) 
  • Casual, Lane & Funsplash swimming sessions  
  • Racket sports for NL Ignite members including Badminton, Pickleball, Short Tennis & Table Tennis. Squash & Racket ball – maximum of 4 players  
  • Programme reviews 
  • 7-days ahead booking   
  1. Membership fees and charges and termination  

2.1  Your child can use this Membership at any Facility and the price for this membership is £19.99 per month (“Membership Fee”) but may be subject to change in accordance with clause 10.6 of the General Terms and Conditions. 

2.2 You shall pay your child’s Membership Fee in accordance with clause 10 of the General Terms and Conditions. 

2.2 Use of certain activities not included as part of your child’s membership package will be subject to payment of current fee charges, which are in addition to this Membership subscription. 

  1. Your child’s NL Ignite Membership Fee will be valid until they reach the age of 18 years. We will contact you one (1) month prior to the date your child turns 18 years old to inform you of the membership options. If you do not confirm you wish your child to have a new Membership then your child’s Membership and this Contract will automatically terminate the at the end of the month in which your child turns the age of 18.  
  1. Rules and regulations 

3.1  You must consent to your child joining this membership by signing this Contract.  

3.2 If you wish for your child to access the Facilities without you present and they are under the age of 16 you must complete and sign a waiver. You can obtain the waiver form us and must be completed, signed and return to us at a Facility. 

 

  1. Use of equipment and facilities

4.1  Before using the gym, all junior members must complete an induction with an instructor who will explain the safe and proper use of the equipment. Your child must not use any equipment or undertake any exercise that you have not been instructed to use. 

  1. Your child is limited to using the cardio-vascular equipment and floor work for circuits only. The use of free weights is not permitted. 

 

NL Collective – (Corporate)Specific Terms and Conditions 

These terms and conditions form our Contract with you and should be read in conjunction with the General Terms and Conditions.  

  1.  Membership 

1.1  We operate seven Gym/ Leisure Facilities within North Lincolnshire. Our membership gives you access to the following facilities: 

  • Ancholme Leisure Centre – Brigg 
  • Axholme North Leisure Centre – Crowle 
  • Baysgarth Community Hub – Barton-Upon-Humber 
  • Live Well Isle of Axholme – Epworth 
  • Riddings Community Hub – Scunthorpe 
  • The Pods – Scunthorpe 
  • Winterton Gym – Winterton 

 

1.2 This Membership includes:

  • Group fitness classes including virtual and excluding referral classes

2.1  You can use your Membership at any Facility and the price for this membership is £29.99 per month (“Membership Fee”) but may be subject to change in accordance with clause 10.6 of the General Terms and Conditions. 

2.1 Your membership will run for a period of 12 consecutive months from the date of payment and will terminate automatically at the end of the twelfth month. You shall pay your Membership Fee in accordance with clause 10 of the General Terms and Conditions. 

2.3 Upon termination if you wish to continue with your membership you must submit a new application including providing evidence of your eligibility from your employer. 

  1. Use of certain Facilities/ activities not included as part of your membership package will be subject to payment of current fee charges, which are in addition to this Membership subscription.

These terms and conditions form our Contract with you and should be read in conjunction with the General Terms and Conditions.

3 Eligibility  

3.1 You must provide evidence to us within seven (7) days of you joining that you meet one of the qualifying criteria below. This evidence should be an official awarding letter dated within the last four (4) weeks prior to the date of you joining or if the benefit is paid directly into your bank, a bank statement not more than four (4) weeks old showing the payment. Your Membership will be suspended from the date of joining until you provide the evidence to us. You must bring the evidence to us at the Facility.  

3.2 The qualifying categories for being eligible for this Membership are:  

a. You must be a resident of North Lincolnshire that lives in a property registered for Council Tax with North Lincolnshire Borough Council in receipt of: 

b. Job Seekers Allowance (income based) 

c. Employment Support Allowance (income based) 

d. Income Support 

e. Pension Credit 

f. Housing Benefit 

g. Council Tax Benefit 

h. Working Tax Credits with free NHS costs 

i. Universal Credit 

j. Personal Independence Payment or Disability Living Allowance  

k. Attendance Allowance 

l. Severe Disablement Allowance 

m. Carers Allowance 

n. NLC resident aged 60 years and over 

o. Have an active Health referral stage 2 membership and exiting our NL Exercise Referral programme 

p. Students aged 18 years plus in full time education (21 hrs or more per week) 

q. Care leavers aged 18 to 21 years 

r. Apprentices or other persons on a full-time government training scheme 

s. Armed Forces Community (defined as ‘Service people’) 

t. Members of the regular forces and reserve forces – Royal Navy, Royal Marines, regular Army and Royal Air Force. 

u. Members of British overseas territory forces who are subject to Service Law 

v. Former members of any of His Majesty’s forces who ordinarily resident in the UK 

 

SwimLincs membership

These terms and conditions form our Contract with you and should be read in conjunction with the General Terms and Conditions.  

1.      Membership  
  1. This Membership includes:

SwimLincs   
  • One SwimLincs lesson per week for 50 weeks of the year  
  • Free casual swimming for the child enrolled on the SwimLincs programme – any North Lincolnshire Council managed swimming pool

 

2. Membership Fees, Charges and termination 

2.1  Your child can only access the Facility included within your application and the price for this membership is £29 per month (“Membership Fee”) but may be subject to change in accordance with clause 10.6 of the General Terms and Conditions. 

2.2  Upon joining, you shall pay to us a pro-rata payment which covers the payment of swimming lessons until the first monthly payment is collected thereafter you shall pay your Membership Fee in accordance with clause 10 of the General Terms and Conditions. Your child’s SwimLincs membership will start immediately upon enrolling onto a swimming lesson. 

2.3  If you pay the Membership Fee by MDD and payment is not received by us on the date it is due, the provisions of clause 10.5 will apply and payment must be made before your child’s next lesson. If payment of the Membership Fee is not made by your child’s next lesson this Contract and your Membership will terminate immediately.  

2.4  If your contract is terminated or monthly subscriptions not collected, then the current Membership Fee will be charged to restart the membership. 

2.5  All sessions in the pool timetable stating casual swim are included in the membership welcome letter. Other pool sessions will be subject to payment of the current fee charges, which are in addition to your child’s membership subscription. 

2.6  If we are unable to deliver your child’s swimming lesson due to unforeseen circumstances, your monthly collections will be reduced after a 6-week calculation period to reflect the missed lesson. The adjustment will be calculated at the individual lesson rate at the time applicable at the time your application was dated. 

2.7  A list of tariff charges is available from reception of a facility. 

3. Facilities

3.1  Your child will only be permitted to use the facilities included in their membership package provided their membership is current and fully paid. 

3.2 Our SwimLincs Academy membership gives your child access to one SwimLincs lesson per week for 50 weeks of the year and access to free casual swimming sessions whilst enrolled on the SwimLincs programme. 

3.2  We reserve the right to change the SwimLincs programme, cancel or change a class, withdraw/ remove facilities from time to time for essential repair and maintenance. Any changes will be displayed on the Swimlincs notice board at the facility reasonably in advance. If We make significant changes to the Swimlincs programme or facilities, you can cancel your agreement in accordance with clause 7.3 of the Core Terms and Conditions. 

3.5 Your child will be issued with a membership card which must be shown at reception every time they wish to swim during a casual swim session. Failure to present a membership card will result in us charging the current swim session price.
