Green Homes Grant – privacy notice

Short Privacy Notice – Green Homes Grant

North Lincolnshire Council collects and processes personal data for green home grants schemes, including:

  • A scheme funded by the Green Homes Grant Local Authority Delivery Scheme (GHG LAD), run by the Department for Energy, Security and Net Zero (DESNZ). Nottingham City Council has been appointed by DESNZ to administer the Sustainable Warmth Competition (SWC) acting as the Midlands Energy Hub. Currently LAD 3 is live.
  • The Midlands Net Zero Hub (MNZH) as part of Nottingham City Council is leading on the regional delivery of a project called Home Upgrade Grant Phase 2 (HUG 2). HUG 2 is a national government scheme funded by the Department for Energy Security and Net Zero (DESNZ) which awards grants to Local Authorities for energy efficiency and clean heating upgrades in owner occupied and private rented sector fuel poor homes off the gas grid. It will provide energy efficiency upgrades and low carbon heating via local authority funding, to households in England that are low income, are off the gas grid or have an Energy Performance Certificate (EPC) between D and G. HUG 1 is a similar scheme that will be complete by July 2023. HUG 2 will follow on from HUG 1.

Yorkshire Energy Solutions (YES) have been appointed by North Lincolnshire Council to assess and deliver green home initiatives in North Lincolnshire.

MNZH will share personal data with a DESNZ delivery partner or agent as an installer. The purposes for which DESNZ and/or DESNZ delivery partners/agents are processing personal data is to support the delivery and administration of the scheme. This includes the assessment of applications by the local authority for the funding of installations at the property, monitoring the use of the DESNZ funding and creating a record of installations.

Delivery and administration of the scheme may require linking of personal data to other datasets held by DESNZ and/or DESNZ delivery partners/agents.

DESNZ will be conducting an evaluation of the scheme. This may include being contacted by DESNZ or its delivery partners/agents to take part in further research. Where the research involves processing of personal data in addition to that already collected for delivery of the scheme, the opportunity will be given to opt-in to that research at the point of contact.

Personal data will be handled in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 and will not be disclosed to any other third party unless this is allowed or required by legislation. Yorkshire Energy Solutions (YES) will collect and use personal data to confirm eligibility for the scheme, provide customer support and advice about energy efficiency, and if eligible, refer details to the relevant local authority scheme to enable a survey and installation to take place.

  • DESNZ – once personal data has been shared with DESNZ or its delivery partners / agents, DESNZ will become a Data Controller for that personal data.

Purpose of this Privacy Notice

This Privacy Notice tells you what to expect when we are processing your personal data is to support the delivery and administration of Green Homes Grant schemes.

What do we mean by personal data?

Personal data relates to living persons and is information that can be used to identify an individual such as name, date of birth, address, or postcode.

What do we mean by special category personal data?

The UK GDPR defines special category data as:

  • personal data revealing racial or ethnic origin;
  • personal data revealing political opinions;
  • personal data revealing religious or philosophical beliefs;
  • personal data revealing trade union membership;
  • genetic data;
  • biometric data (where used for identification purposes);
  • data concerning health;
  • data concerning a person’s sex life; and
  • data concerning a person’s sexual orientation.

Please note that separate rules also apply to personal data about criminal allegations, proceedings, or convictions.

What data do the Data Controllers – North Lincolnshire Council, MNZH and Yes Energy Solutions Collect and Use?

  1. Personal Data

    • Home address – if applying or being referred for installation of a measure.
    • Contact details – applicants contact details and contact details for the owners (if different).
    • Eligibility and funding – details about how and why you were identified by your Local Authority for participation in HUG 2 and details about any financial contributions you have made towards the cost of the installation, including benefit eligibility and details of any additional funding used to support the installation, for example from the owners, landlords or other third parties.
    • Measures installed – details of the energy efficiency measure, or low carbon heating system installed, including type, size, and cost.
    • Property heating scores – pre and post installation property SAP or RdSAP assessments with scores.
    • Details of installers – in relation to each installation of a HUG 2 measure, including your contact details and any relevant accreditation or registration information.

2. Special Category Personal Data

    • No special category personal data is collected.

What data do the Delivery Partners / Agents (Installers) Collect and Use?

  1. Personal Data

    • Name, contact business address, email address and phone number.
    • Relevant accreditation and registration information.
    • Business information, including name, type of business and number of employees.
    • Details of installations delivered under the scheme, including type, size and cost and details of the properties at which the installations are installed.
    • Whether directly contracted or sub-contracted to install installations under the scheme.

2. Special Category Personal Data

No special category personal data is collected.

Who do we share your data with?

The Data Controllers – North Lincolnshire Council, MNZH and Yes Energy Solutions will only share personal data with other departments within their organisations and with other organisations when this is necessary to provide services and when there is a lawful basis to share with them. The Data Controllers may also share your information when we are obliged to by law.

In relation to the scheme, the Data Controllers will share personal data with each other and with the following organisations:

  • DESNZ
  • Yes Energy Solutions
  • Installers or Assessors of energy efficiency measures appointed by the Local Authority.

Personal information provided may also be used for the purpose of any other function carried out by the Nottingham or North Lincolnshire councils. This may include sharing information across the council, or with external organisations. Delivery partners / agents (installers) will share personal data with:

  • DESNZ and its delivery partners / agents for delivery, administration, audit and evaluation of the scheme, statistical research and fraud prevention purposes.
  • Ofgem and other organisations administering other central and local government schemes that support energy efficiency or low-carbon heating measures. This is to prevent the duplication of support or other breach of scheme rules.

Personal information will only be used for another purpose where it lawful to do so.

How do we get your personal data and why do we have it?

Personal data is collected when someone applies to access the scheme.

The lawful basis we are relying on to process personal data is:

  1. Performance of a task carried out in the public interest or in the exercise of official authority– Article 6(1)(e)
    The main applicable legislation is the Warm Homes and Energy Conservation Act 2000 and the Fuel Poverty (England) Regulations 2014.
  2. Consent – Article 6(1)(a)
    Use of your personal data to contact you to take part in further research will be subject to your consent.

Personal data will only be processed when it is necessary and where there is a lawful reason to do so.

Can I withdraw my consent?

Yes, where the processing is on the basis of consent.

How long will your personal data be retained for?

Personal data is retained in accordance with national guidance and our legal obligations.

In this instance North Lincolnshire Council will retain personal data for a maximum period of 25 years following the close of the scheme.

DESNZ will also retain personal data for a maximum period of 25 years following the close of the scheme but not longer than required.

Personal data may be anonymised and kept for a longer period, for example for statistical purposes.

Your Data Protection Rights

Under Data Protection law, you have rights including:

  • Your right of access – to ask us for copies of your personal information.
  • Your right to rectification – to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
  • Your right to erasure – to ask us to erase your personal information in certain circumstances.
  • Your right to restriction of processing – to ask us to restrict the processing of your information in certain circumstances.
  • Your right to object to processing – to object to the processing of your personal data in certain circumstances.
  • Your right to data portability – to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
