Winterton Article 4 Direction

Town and Country Planning Act 1990 and Town and Country Planning (General Permitted Development) Order, 1995
North Lincolnshire Council (Winterton) Conservation Area Direction 2011

WHEREAS the Borough Council of North Lincolnshire (hereinafter called “the Council”) being the local planning authority for the area is satisfied that it is expedient that development of the descriptions set out in the Schedule below should not be carried out on the land shown delineated and edged in red on the plan annexed hereto and comprising the Winterton Conservation Area unless permission therefor is granted by the Council on an application made in that behalf.

NOW THEREFORE the Council in pursuance of the powers conferred upon it by article 4(1 )(a) of the Town & Country Planning (General Permitted Development) Order 1995 (as amended) HEREBY DIRECTS that the permission granted by article 3 of the said Order for those forms of development set out in the Schedule hereto shall not apply to development on the said land.

THIS DIRECTION may be cited as the North Lincolnshire Council (Winterton) Conservation Area Direction 2011.

Schedule

Development comprised within Parts 1, 2 and 31 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 as follows:

Part 1: Within the curtilage of a dwelling house

Class A – The enlargement, improvement or other alteration of a dwelling house, where any part would front a relevant location;
Class C – The alteration of a roof slope fronting a relevant location;
Class D – The construction of a porch to an external door that fronts a relevant location;
Class F – Provision of a hard surface within the curtilage of a dwelling house where it would front a relevant location;

The erection, alteration or removal of a chimney on a dwelling house or a building within the curtilage of a dwelling house;

Part 2: Minor operations

Class A – The erection, construction, maintenance, improvement or alteration of a gate, fence, wall or other means of enclosure within the curtilage of a dwelling house and fronting a relevant location;
Class C – The painting of the exterior of any part of a building fronting a relevant location provided it is a dwelling house or a building in the curtilage of a dwelling house.

Part 31: Demolition of buildings

Class B – the demolition of the whole or any part of a gate, fence, wall or other means of enclosure within the curtilage of a dwelling house and fronting a relevant location.

A “relevant location” means a highway, waterway or open space.
