Requesting personal information

Find out how to request access to the information we hold about you and the services you receive from us.

Subject Access Request (SAR)

The UK General Data Protection Regulation (UK GDPR) gives you the right to request access to the information we hold about you and the services you receive from us.  This is known as making a Subject Access Request (SAR).

You can make a SAR request either verbally or in writing. There is no charge to make a request and generally no charge to provide you with information.  We would prefer you to make your request in writing so that we are clear about the information you would like to access.

We have created a Subject Access Request Form [Doc, 59Kb] or Subject Access Request Form [PDF, 120Kb] that can be printed to help with your request.  This form also explains about identification (ID) that we will need to see before we release any information to you.

Please address your form to the Information Governance Team and email to informationgovernanceteam@northlincs.gov.uk or send it by post to North Lincolnshire Council, Information Governance Team, Church Square House, 30-40 High Street, Scunthorpe, DN15 6NL.

Generally, other people cannot access your personal information. But in certain circumstances this may be permitted. Such as where you have given written permission for someone else to make a request on your behalf, or where you have parental responsibility.

When we respond, some information might be withheld or redacted. Such as where another person is referred to, or where releasing the information is likely to compromise the prevention and detection of a crime.

Generally, we will not charge to provide you with information. Where we are considering a charge, this will be as permitted by the General Data Protection Regulation and we will discuss this with you.  An example is where you would like a second paper copy of information we have already provided.  Please see our Information Charging Policy [PDF, 185Kb] for further information.

Investigatory requests for information

Please see below for details about making an investigatory request for personal information.  Please contact us if you would like further advice about your request.

Under Schedule 2, Part 1 (Paragraph 2) of the Data Protection Act 2018, organisations such as the police, government departments and local authorities with regulatory powers are able to request access to third party personal information without the consent of the data subject for the purposes of:

  1. prevention or detection of crime
  2. the apprehension or prosecution of offenders; or
  3. the assessment or collection of a tax or duty or an imposition of a similar nature

There is no automatic right of access to information under Schedule 2, Part 1 (Paragraph 2) of the Data Protection Act 2018.  Each request will be considered to decide whether or not to apply the exemption and provide the information. This guidance does not overrule or replace other Information Sharing Agreements, Memorandum of Understandings or Processes.  Please also note that your request must be authorised by an individual with sufficient seniority to authorise the request.  Further information is provided on the Schedule 2 Request Form.

  • Where disclosure is required by or under an enactment, by any rule of law or by the order of a court
  • For the purpose of, or in connection with, any legal proceedings (including prospective legal proceedings) or for the purpose of obtaining legal advice or establishing or exercising or defending legal rights

Annex C requests relate to an allegation of abuse of a victim aged 17 years or under, either currently or at the time of the offence under the 2013 Protocol and Good Practice Model. Disclosure of information in cases of alleged child abuse and linked criminal and care directions hearings.  The Local Protocol for the area applies to Annex C requests relating to the following parties to the agreement:

  • The Resident Judge of Kingston upon Hull
  • The Resident Judge of Great Grimsby
  • The Designated Family Judge of Humber
  • East Riding of Yorkshire Council
  • Hull City Council
  • North Lincolnshire Council
  • North East Lincolnshire Council
  • Humberside Police
  • Yorkshire and Humberside CPS
