Planning appeals

What if my planning application is refused?

Information regarding all the recent changes to the appeals process can be found in the following document from The Planning Inspectorate:

If your application is refused and you think that it could be altered to make it more acceptable you can then resubmit it with different plans.

If you intend to submit another application, you should discuss this with the case officer.

The other option is to appeal against the refusal. You can appeal if:

  • Your application is refused
  • A decision is not made (non-determination) within the determination period allowed (usually eight or 13 weeks)
  • Your application is granted subject to conditions you are unhappy with.

The only person who can appeal against a planning decision is the applicant There is no third party right of appeal.

The usual period allowed for submission of an appeal is six months from the date of your decision notice. All appeals are considered by an Inspector appointed by the Secretary of State.

How to make an appeal:

You can appeal online via the planning portal. The site also allows you to:

  • Track the progress of your appeal
  • Submit comments on an appeal
  • Submit any additional documents.

Fast track appeals for householder applications

Central Government has introduced a more simplified approach that should help to speed up the appeal process.

The new legislation will only apply to anyone who has had an application refused for alteration or extension to an existing dwelling, or development within the curtilage of such a dwellinghouse for any purpose incidental to the enjoyment of the dwellinghouse.

Not included under the fast track procedure:

  • An application for a change of use,
  • An application to change the number of dwellings in a building.

Scope of the householder appeals service:

  • Appeals against refusals on householder applications which will proceed on the basis of written representations.

Not within the scope of the householder appeals service:

  • Appeals against any grant of planning permission which is granted subject to conditions
  • Appeals against a local planning authority's failure to determine a householder application (non-determination)
  • Appeals against Listed Building Consent or Conservation Area Consent
  • Appeals against lawful development certificate applications
  • Appeals against enforcement notices
  • Appeals against applicatons for advertisement consent.

Time limits to appeal

There is a shortened time limit of 12 weeks from the date of the notice of decision in which to appeal.
