Permitted development rights

If you live in a single occupancy (family), house in a conservation area, you can normally undertake 'minor works' e.g. changing windows and doors, without making planning applications. This is because you have what are called ‘Permitted Development’ rights.

The council can however control minor works  by means of an Article 4 Direction

This direction removes all or some of the permitted development rights within part of the councils area. In some parts of the council's conservation areas permission is likely to be required for minor works affecting  the appearance of family houses. These works may include:

  • Extensions to the property.
  • Outside alterations such as new windows or door.
  • Re-roofing or alterations to the chimneys ridge, tiles etc.
  • Porches.
  • Covering gardens in tarmac or concrete.
  • Removing garden walls.
  • Creation of car parking space.
  • Putting up gates fences or walls.
  • Covering walls by rendering or painting the brick work.

None family buildings - Planning permission will be required for works which affect the appearance of non family dwellings e.g. flats, offices, shops and some industrial/commercial buildings, whether they are in a conservation area or not. 

Planning conditions - The council can also remove permitted development rights by means of conditions on the grant of a planning permission.

Repair - Provided the same types of material and construction are used, the repair and maintenance of buildings does not need planning permission.

Listed below are those conservation areas in North Lincolnshire which are currently subject to Article 4 directions.

  • Alkborough
  • Appleby
  • Barrow upon Humber
  • Barton upon Humber
  • Brigg
  • Burton upon Stather
  • Kirton in Lindsey
  • New Frodingham, Scunthorpe
  • Saxby All Saints

New directions - By end 2013 the council aims to rationalise its use of Article 4 Directions by making a new  series called Article 4 (2) Directions.  These will control minor works affecting those parts of family houses visible from public places in conservation areas. 

Except in Burton upon Stather, New Frodingham and Saxby All Saints, exiting Article 4 Directions will be replaced by Article 4 (2) Directions. 

Ultimately all 17 of the council's conservation areas will be covered by some form of Article 4 Direction controlling minor works.
