Premises licence

This licence authorises the use of all premises for licensable activities described and defined in section 1 (1) of the Schedules 1 and 2 to the 2003 Act. ‘Premises’ is defined in the Act as:

  • a vehicle
  • a vessel
  • a moveable structure
  • any place, or
  • a part of any premises.

The licensable activities are:

  • The sale by retail of alcohol. This now includes wholesale of alcohol to a member of the public in wholesale quantities. The 1964 Act excluded this.
  • The supply of alcohol by, or on behalf of, a club to member of the club.
  • The provision of regulated entertainment, such as:
    • the performance of a play
    • the exhibition of a film
    • indoor sporting events
    • boxing or wrestling
    • performance of live music
    • playing recorded music
    • performance of dance
    • entertainment similar in description to the above.
  • The provision of late night refreshment. Providing hot food or drink between the hours of 11pm and 5am.

Grant application:

  • Any person aged 18 or over who is carrying on, or who proposes to carry on, a business that involves the use of premises for licensable activities may apply for a premises licence. ‘Premises’ is any place, including one in the open air. A ‘person’ includes a business or a partnership.
  • You must make an application for a premises licence to North Lincolnshire Council. You must copy it to the appropriate responsible authorities (see below) within 48 hours of the application being made.

You must include:

  • a completed application form.
  • the required fee (see below).
  • a plan of the premises in the correct form (1:100).
  • if the application involves the supply of alcohol, a form of consent from the individual who is to be specified in the licence as the designated premises supervisor (see below).
  • Applications must be advertised. This is by way of a form of notice displayed on the boundary of the premises and in a window on each side of the premises. The public must have access to the windows displaying the notice. The notice must face out from the premises so people passing by can easily read it. The notices must be printed on A4 pale blue paper. Forms for your use are available from all Local Link offices and from the Licensing Division at Church Square House in Scunthorpe. A copy of the notice must be placed in a locally circulating newspaper on at least one occasion within 10 days of making the application.
