- Resolved - That the minutes of the proceedings of the meeting held
on 23 April 2007, having been printed and circulated amongst the members, be
taken as read and correctly recorded and be signed by the chair.

(1) APPLICATIONS DEFERRED FROM PREVIOUS MEETING -In accordance
with the decisions at the previous meeting, members had undertaken site visits
on the morning of the meeting. The Head of Planning submitted reports and updated
them orally.
(i)
08/0345 by Mr S Clark for planning permission to erect a new grain store, garaging,
workshop and store, (including demolition of existing derelict sheds), at High
Burnham Farm, High Burnham, Haxey.
Prior
to consideration of this application a supporter of the application addressed
the committee. He stated that there was no other building on the site suitable
for storing grain. This was vital for the farm to function as an agricultural
operation. It would be on the site of a brick outhouse that had already been
demolished. Storing cereal produced on the farm rather than taking it away for
storage would reduce the amount of traffic generated by the business.

Stewart, attending the meeting in accordance with the provisions of Procedure
Rule 37 (b) spoke on this application.

(ii) 08/0199 by I E Akester for planning permission for change of use of existing
ground floor flat to a sandwich bar, at 49 Waterside Road, Barton on Humber.
Prior
to consideration of this application the applicant addressed the committee.
He stated that the site was surrounded by residential properties and a large
supermarket. There was a lack of parking space for people wishing to buy sandwiches
in the town centre. The site was close to the Humber Bridge Viewing Area. The
property had been a shop for 180 years. The proposal had considerable local
support.
Members
considered that there was a clear need for the proposal and that no alternative
sites were available nearer to the town centre.
Resolved
- That permission be granted subject to conditions restricting opening
hours to between 8.30 am and 7pm on Mondays to Saturday and 10.30 am to 4.30pm
on Sundays and Bank Holidays and prohibiting the reheating, cooking and production
of hot food on the premises.

08/0296 by Mr P Fryer for planning permission to erect a replacement dwelling
(including demolition of existing dwelling), at 35 North Street, Winterton.

07/1942 by Mr P Trevethan for planning permission to convert part of an existing

08/0396 by Ms D Bolland for planning permission to erect five dog kennels with
associated service sheds (re-submission of PA/2007/0694), at 335 Messingham
Road, Bottesford.
Prior
to consideration of this application the applicant and an objector addressed
the committee. The applicant stated that she was an accredited Kennel Club breeder
and a responsible dog owner. There would be one dog in each kennel. She had
taken into account the concerns of neighbours. The development would be in keeping
with the locality. The kennels would be 30 metres from the nearest properties.
When the dogs were outside they would be supervised by the applicant or members
of her family. Any fouling would be dealt with immediately. There was
no intention to cause disruption or distress to neighbours.
The
objector was concerned that the kennels could be used for commercial breeding.
He stated that the development would affect the rights of neighbours to enjoy
their gardens.
Councillors
Mrs Bromby and Swift addressed the committee in accordance with Procedure Rule
37(b).
Members
were concerned that the development would lead to a loss of amenity to neighbouring
dwellings.

(2) PLANNING APPLICATIONS - The Head of Planning
submitted a report incorporating a schedule containing details of applications
for determination by the committee including summaries of policy context, representations
arising from consultation and publicity and assessment of the applications.
(i)
07/1129 by Singleton Birch Ltd for planning permission for the extension of
a quarry with restoration to agriculture, woodland and nature conservation,
at land to the north and east of Melton Ross Quarries, North side of the A18,
Croxton.
Resolved
- (a) That the Secretary of State be advised that on completion of a formal
agreement under Section 106 of the Town and Country Planning Act 1990 providing
for the implementation of an archaeological mitigation strategy (including a
written scheme of investigation) temporary closure of a section of Bridleway
34 and creation of new bridleways and public footpaths, the council is mindful
to support the development subject to the conditions set out in the report
and an additional condition relating tio a landscaping scheme, and (c) that
if the obligation is not completed by 30 September 2008, the Head of Planning

was concerned that the proposal would cause noise nuisance to neighbours, the
nearest of which was 100 metres away from the site. It would attract troublemakers.
The fencing and lighting would be obtrusive.

to by the objector were not able to be conditioned and that an amended plan
would be required if these issues were all to be addressed.

The
objector stated that the access arrangements were unsatisfactory. Applications
to develop the site had been refused previously, including on appeal. The dwelling
would be too large for the site and out of place in the street scene. This application
did not address the reasons for the previous refusals. The proposal would adversely
affect the amenities of neighbouring properties and it failed the meet the "40
degree test".
The
applicant's agent stated that the plans had been changed significantly
since the previous refusal. The proposed building had been reduced by some 30%
in size. The nearest window was 20 feet from the nearest property.

(xvi)
08/0561 by Havelock Homes, c/o Longhurst Group Ltd for planning permission to
erect four two bedroom apartments with associated parking and amenity area,
at land adjacent Cherry Tree House, Collum Avenue, Scunthorpe.
Prior
to consideration of this application Councillor Wilson addressed the committee
on behalf of an objector. The objector was concerned about access and parking.
He also expressed concern about the loss of green space and the potential for
an increase in vandalism
Resolved

(3) APPLICATION FOR APPROVAL OF RESERVED MATTERS FOLLOWING THE GRANT OF OUTLINE
PERMISSION - 08/0472 by Mr & Mrs Taylor for approval of reserved matters
(layout, scale and appearance) following the grant of outline planning permission
2004/0901 allowed on appeal 06/04/2005 for the erection of a chalet dwelling
and detached garage, at land to the rear of 10 High Street, Burton Stather.
The
Head of Planning submitted a report informing members about an application for
approval of reserved matters which was ready for determination. Outline planning
permission had already been granted and the developments had therefore been
agreed in principle.
Consideration
was now required to the details of the siting, design, external appearance,
means of access and landscaping of the developments (excluding any of these
matters which were expressly approved at the time outline permission had been
granted).
Prior
to consideration of this application the applicant addressed the committee.
He was happy to accept all of the proposed conditions other than that relating
to window materials. He asked members to consider allowing the use of wood grain
effect UPVC as other properties surrounding the site had such windows.
Resolved
- That approval be given subject to the conditions contained in the report
with the exception of condition 5 to be amended by the deletion of "and
all windows and doors...."
