Control and advice

If you intend to demolish a building, you must give notice to the council at least six weeks prior to work commencing.

To view and print the application form you will require the appropriate software. An Adobe Acrobat reader can be downloaded free from the Adobe website (full instructions for downloading the reader are provided on the web site).

A location plan of the building and adjoining streets must be provided together with a method statement for the demolition of larger buildings.

Statutory undertakers should also be notified in order that they may arrange for their services to be properly sealed.

Enforcements

Building or demolition works can cause problems for neighbours of the site. To reduce causing any nuisance to the neighbours, or action being taken by the council, follow this advice:

  • Give the council six weeks' notice of demolition work. The council may impose some conditions about how the work should be done.
  • Send a letter to the neighbours before work starts, telling them about the work and what to expect. Give the neighbours a contact name and telephone number and keep them informed.
  • Deal promptly with any complaints received on site.

Keep dust, noise and smoke to a minimum

Dust:

Keep dust down by spraying with water when and where you can.

Noise:

It is a little difficult to be clear-cut about noise. There is no legal requirement for construction sites to work specific hours.

If we receive a complaint about commercial noise, we usually talk to the site manager. We advise that working outside the hours of 7.00am and 5.00pm is likely to generate complaints. If it is of a noisy nature such as a generator running at 6.00am or demolition taking place at 8.00pm, people are likely to complain. We also advise against working on Sundays and Bank Holidays. It is also recommended to restrict Saturday working to a half day, starting a little later than usual.

BS 5228 'Noise & Vibration Control on Construction & Open Sites' gives guidance on best practice for construction sites.

Occasionally, a construction company may need to work anti social hours. A company may have advised the council that work must be carried out to ensure completion of a task, such as a major road may be worked on during the night to help reduce traffic congestion during the day. In such cases, the council will have been satisfied that all appropriate noise control measures are in place. It will have been notified in writing at least three weeks beforehand.

Smoke:

Generally speaking the council will visit a construction site and discuss how the fire started, advise the site manager on his 'duty of care' with regard to his waste. Burning is not an option, although some sites may have applied for an Exemption Certificate from the Environment Agency to enable them to burn clean wood, paper and card. This does not, however, exempt them from giving rise to a Statutory Nuisance under Sec 79 of the Environmental Protection Act, 1990 or committing an offence under the Clean Airs Act, 1993.

Obstruction, damage and closure to pavements

  • Do not let vehicles or materials block or damage the pavements
  • Do not leave obstacles, holes or trenches where they are a danger, especially to disabled people (e.g. the blind)
  • The council may charge you for any damage caused to pavements, kerbs or verges
  • Permission is required before a footpath is closed
